who voted, with one abstention, jed york, the 49ers owner. york didn't vote due to a lack of player involvement in the decision, he said. and he added the team plans to stop selling concessions during the national anthem, as well. joining us now is joe fonzi. this is afternoon a year of emotional debate. >> it's hard to imagine anything more divisive. it's still the most watched sport across the country. and the protest last season, opinions on how appropriate the protests were ran the gamut. the league tried to come up with a solution that would apiece both sides. it started as a relatively unnoticed one-man protest two seasons ago. colin kaepernick's decision to "take a knee" during the national anthem sparked emotion on both sides of the flag versus patriotism issue. the movement grew. the weekend after the president made comments in alabama referring to nfl players as sobs. >> he's fired. >> reporter: --owners and players alike thought they had

to express different forms of team unity during the anthem. today, commissioner roger goodell announced the decision by the owners designed to apiece both sides. -- designed to appease both sides. >> we want people to be respectful of the national anthem. we want people to stand. that's all personnel. and make sure that they treat this moment in a respectful fashion. that's something that we think we owe. we have been very sensitive in making sure that we give players choices but we do believe that that moment is an important moment and one that we are going to focus on. it was unanimously adopted by the clubs. >> reporter: not quite. the vote wasn't 32-0. 49ers ceo jed york abstained from the vote. in interviews today york said,

>> reporter: a further clarification of the new policy. teams will not be required to be on the field for the anthem, but protests will be punished. based on the discretion of individual teams. new york jets chairman and ceo christopher johnson is already on record saying, his team will not impose any new club rules, fines or restrictions. and the players union obviously has a stake in today's decision. that body was not consulted by the owners and issued this statement: >> the owners objective today was to obviously bring clarity to a divisive issue last season. it remains unclear if they have accomplished that. the 49ers have said they will close the concession stands during the anthem.

today's announcement seems to be putting most of the emphasis on the individual teams. the original objective was to bring some clarity to a divisive issue. it's unclear to me if they have now accomplished that. >> the nfl still has ratings but there's no questions that the ratings have tanked in part because of the protest. how do you think fans will react to this decision here by the owners? >> i'll start with the first premise. that's speculative. the year before that happened, the ratings were already down. thigh thing that spurred the big reaction is the things that the president said in alabama when he called them sobs. hubs protested after that. it was a situation where the team concept if you have ever been in a locker room or on a team you may be the person next to me, i may have absolutely nothing in common with you, but as a teammate, we put all that aside and go

out on the field and play together. when somebody called you a name, you just called me a name, as well. that's what happened after everything happened in. completely separate from how this all started as individual sides take what was originally intended to be take it politically hostage. i don't know they have solved it. >> thank you. fans we spoke with had mixed reaction with people taking both sides of the issue. >> seems a reasonable way of solving it. they have -- they can still protest but not in front of everybody else during the national anthem. they are saying the players should stay at the locker room. if they want to kneel down they should stay in the locker room? that's ridiculous. they have freedom of speech and the freedom to do what they want to do. if they want to kneel during the national anthem, has nothing to do with disrespecting the flag. it has something to do with what they are standing for.

>> truthful opinion i think they should have all kept it -- they should have kept it separate from the nfl. let the guys play. i understand why talking about when kaepernick started all this i understand his point. i understand his point. i just felt that, um, they should have kept it out of the nfl. >> reporter: reaction is pouring in online. from vice president mike pence to the aclu, people and groups on both sides of the debate are weighing in. you can share your thoughts with us on twitter or facebook. more news now with the 49ers. reuben foster can now rejoin the team after domestic violence charges against him were dropped today. when asked if he was relieved by the judge's decision, foster gave us thumbs up as he left the courtroom. last week his ex-girlfriend took back her allegations of abuse. she told the court that she lied after he dumped her.

the judge says she reviewed 911 calls, witness statements and injury photographs and said she believed ennis lied. >> today reuben foster's defense team scored a touchdown. this could not have gone better for the reuben foster team. and what the judge said is that it's not just the recantation by miss ennis that led to the decision, but it was the entirety of the evidence that was put on at the preliminary hearing. >> the 49ers released a statement saying: the santa clara county district attorney's office meantime says it is disappointed in the decision. it went on to say, recantation is common among domestic violence victims. some are scared, some feel guilty, some are coerced, some need money.

whatever the cause, we move forward on cases when victims falsely recant because we know that if we don't, more victims will be hurt. some developing news from san francisco where firefighters are reporting one minor injury after a tour bus caught fire. it happened about 4:30 in the 300 block of columbus avenue in north beach. crews took 30 minutes to extinguish it. one person was treated for smoke inhalation. the flames caused significant damage to the front of the bus. no word on the cause. at sfo, the wing of an airline link gust passenger jet hit a concrete support -- aer lingus passenger jet hit a concrete support. it landed at 3:15. no injuries. we don't know yet how much damage there was to the plane. but we are told that no other flights were affected. a federal judge in new york city has ruled that

president trump cannot block twitter followers for their political views. the judge says it's a violation of the first amendment. the president's effort to silence his critics is not permissible because the digital space you uses to connect with the people is a public forum. the ruling rejects administration arguments that the first amendment doesn't apply in this case because the president is acting as a private individual. secretary of state mike pompeo said today plans for next month's scheduled summit between president trump and north korean leader kim jong- un are still moving forward. that's despite growing concerns the history making face-to-face meeting may not happen on the scheduled june 12th date. reporter ellison barber joins you live from washington, d.c. with the story. >> reporter: hi, heather. there are more reports coming out tonight that perhaps put this meeting in even bigger question mark territory. the reports coming from north korean state media that a foreign ministry official in north korea will suggest to

everything. >> reporter: we told her about a new app launched by oakland called oak 311. she says she will use it. >> because it's easier than trying to call 911. >> reporter: that's what mayor schaaf wants to hear. last month, the mayor introduced oak 311 to report things like potholes, graffiti and illegal dumping. ever since it went online, complaints have gone up 12% from 5,291 requests last year to 5,916 during the same time frame last year. >> we need all hands on deck to address the quality of life issues in oakland and 311 gives everybody the tool to be part of the solution, to be the eyes and ears for the city so we know where to go and what to do, what you need fixed. >> reporter: when it comes to illegal dumping, the mayor says the city has a goal. >> we want to see at least 90% of those complaints picked up within three business days. frankly, i'd like it to be one business day. >> reporter: chang hopes the city will respond quickly after she reports problems so

"2 investigates" tonight human waste being dumped day after day in a residential area. neighbors are upset over septic tank trucks unloading cargo down a manhole on their sidewalk. but we have learned that these companies actually aren't breaking the law. in fact, they have been told that this is their assigned dumping spot. "2 investigates"' brooks engineer rose has been looking into the complaints and why the sanitary district says this is normal operating procedure. >> reporter: the neighbors say that odor smelling rotten eggs or spoiled milk shouldn't be normal. after all, this is their street and sidewalk and their

backyards back up right to it and you can see in this photo, there is the truck. here's where it's backed up with the hose coming into this manhole where all the waste is dumped. another man tells me he lives in this property right behind this fence and he says his kids play on the trampoline feet away from the dumping. those who lived here in castro valley can't understand why the sanitary district managers would pick their street to dumb human waste down the man home. it's part of a program that was started in 2015 to help companies properly dispose of waste water. companies are charged a permit fee and five cents for every gallon of sewage that's dumped here. that district received $20,000 last year for the waste water. neighbors says you wouldn't know all the trucks are dumping here because it looks like any other sewer cover in the middle of the sidewalk. >> pretty wild that just right here on the side of the road he picks up a manhole and

pumps raw sewage into the ground multiple times throughout the day. my kids are out here playing, i'm out here doing things with my family, they are pumping thousands of gallons of raw sewage in the ground 10 feet away from me. >> originally looks suspicious to us. there have been complaints. there have been warnings. but all in all, the sanitary district says the company's dumping have a good record. tonight we hear why this was chosen and what's being done since "2 investigates" got involved, that's coming up tonight on the ten o'clock news. >> i'll sure be curious to hear that. i don't -- i don't think anybody in their right mind would want that dumped with a fence or not. >> and why this spot was chosen. it has to do with the size of the pipes that can accommodate the waste water. >> if you have a tip for "2 investigates," email or call us.

details about the deaths of two whales found last week. officials from the marine mammal center in marin county said today both died from injuries caused by people. scientists say the fin whale that was found near jack london square in oakland on friday morning died after being struck by a ship and that the gray whale carcass that washed ashore in marin county later on friday died after being severely entangled in an accident possibly involving a ship's propeller. 13 every experts say accidents involving ships are the leading cause of whale deaths and that the busy shipping lanes around the golden gate can be particularly treacherous. construction is about to begin on a new housing and business development in alameda that promises to transform a section of the former military base there. rob roth tells us it's taken two decades to get here but the plan includes pretty much something for everyone.

are, quote, morally the most debased people on the face of the earth. that chinese resorted to trickery and duplicity to circumvent our laws. >> reporter: leaders from a coalition of asian-american and other community groups today launched their effort asking the public safety and neighborhood services committee to consider the name change. organizers say that as a lawmaker, khan actively supported the chinese exclusion act aimed at keeping chinese immigrants out of the country and used racial stereotypes to support the ban. already, five of the city's supervisors have signed on to change the name putting it in a broader context saying, especially now, words and names matter. >> especially when an when an immigrant population all over the united states are under attack. even so much more important that we do this here in san francisco. because in san francisco, um, we have values here. >> what i like to do, then, is, um, make a motion. >> mm-hm? >> to pass this out of committee with a positive recommendation to the full board. >> great. without objection that motion passes.

>> reporter: those using the park today say after learning julian khan's back story agreed that it's time to change the park's name. >> now that i know, you know, his name and what he did, i would say that's a good idea to get rid of the name of the park. >> reporter: the committee is going to recommend to the board of supervisors to change the name of the park. the board of supervisors is likely to go with that recommendation and instruct the city's recreation and parks department to seek public input on a new name for that park. there could be a new name in october or november of this year. in san francisco, christien kafton, ktvu fox 2 news. new at 6:30, facebook's ceo mark zuckerberg is in france for important tech talks. french president emmanuel macron hosted a meeting to discuss tax and data protection. zuckerberg joined other tech leaders from microsoft uber

and ibm at a conference named tech for good. former secretary of state john kerry attended. the conference is addressing issues such as data privacy and tech literacy. the meeting comes a day after zuckerberg faced the european parliament in brussels over facebook's involvement in the cambridge analytica breach. three south bay cities will ask residents if the they want to tax some of the biggest employers. tom vacar reports. reporter: following the recent lead of seattle, mountain view, home of google and many other tech companies, and cupertino, home of apple, have recommended to their city councils to put a so-called yearly business per person head tax on the november ballot. east palo alto will do the same. the idea, raise millions of dollars in revenues to make major transportation improvements and start additional affordable middle class housing.

>> $100 for sole proprietor, a little more as you go up. as you get to larger employers over 500, we would have a sliding scale which would bring you up to what could be $250. >> reporter: google, mountain view's largest employer, is looking at millions a year from this but has yet to speak out on the head tax. apple, cupertino's biggest employer, is also looking at millions in head count taxes. >> everybody recognizes that we have a housing crisis and also a transportation crisis. these two are joined at the hip. so i think even major employers are now having a hard time attracting and retaining talent. >> reporter: even mountain view's business-supported chamber of commerce has yet to decide. >> we're reserving our official position until we really truly understand what this revenue measure is going to entail. >> reporter: stanford law professor and urban planning expert michele wild anderson says it's best to let the voters decide but sees the danger that a head count tax to fix current problems, cities just might be tempted

degrees. so temperatures well below average. san francisco 59. that's not that far off because the city and the out at "the avenues" you expect fog this time of the year. not santa rosa at 61 or napa at 63. we're warming up slowly. the story is this big extended marine layer that's going to slowly pinch back down after friday, though. so between now and friday, we have this type of weather to contend with. friday there's even a chance one of the models suggesting for a sprinkle in the forecast or heavy drizzle. you have the sea breeze plus there, and the wind blowing it in there. last night winds at 40 miles an hour. it's still howling. our marine air making it to roseville and grass valley.

the beach in the park is beautiful. the hills not blocking out the deep marine layer. but the farther back teams feels like mount vaca taller so they can dam it up like a levee. temperatures tomorrow like today 60s and low 70s at best. but then it warms up nicely. friday the coolest day of the week but then you see what happens on saturday. saturday, sunday and monday back to perhaps the 90s.
